In the Supreme Court of the colony of Victoria - in its Ecclesiastical Jurisdiction

In the goods of Frederick Thomas Mylrea, late of Richmond, deceased

I Emily Mylrea of Elstenwick, widow of the late Frederick Thomas Mylrea deceased, make oath and say

1. That the said Frederick Thomas Mylrea late of Richmond aforesaid departed this life on the twenty-third day of November in the year of our Lord one thousand, eight hundred and sixty-two, intestate

2. That he left me the said Emily Mylrea his lawful widow and Frederick Garland Mylrea of Sydney in the colony of New South Wales, Rose, the wife of Adam Robertson of Geelong esquire, Clarence MacBreedy Mylrea of Montreal, Canada and Richard Armstrong Mylrea of Melboure, his children and next of kin him surviving

3. That they are the only persons entitled to a distribution of his property

4. That the said Frederick Thomas Mylrea had at the time of his death property in the said colony not exceeding in value the sum of six hundrend pounds and that I the said Emily Mylrea am as I believe entitled to the administration thereof

5. That I have this day caused search to be made in the proper office and find that no caveat has been lodged in this matter.

1. That I will well and truly collect and administer the property of the said Frederick Thomas Mylrea late of Richmond aforesead deceased so far as the same will extend and the law bind me so to do

2. That I will exhibit a full and true inventory of all his property together with a true account of the administration thereof as I may be required by the .... of this honourable Court

3. That I believe the personal property does not exceed in value the sum of six hundred pounds

NOTES

  1. Frederick Thomas Mylrea was born 1803 in London, the fourth child of Daniel Mylrea & Mary Bosley
  2. His father, Daniel, the older son of Thomas Mylrea & Rose Savage, was baptised 1750 in Peel on the Isle of Man
  3. This Mylrea line were the Deemsters/Attorney Generals/ MHKs/ Archdeacons
  4. Father Daniel, hero of the Harpooner incident in 1816, died 1822 in France
  5. Frederick Thomas and his older sister Mary Ann, together with their father, survived the incident. Their mother, Mary Bosley, and two sisters Rose Kingson (1800-1816) and Sophia Ann (1811-1816) were drowned
  6. Two other siblings had died previously: Charles Daniel (1799-1815), Rachel (1808-1811)
  7. Frederick Thomas was an officer in the British Army, Commissary Division. His final posting was to Melbourne in 1859
  8. He married Emily Garland in 1827, and the couple lived in British outposts around the world
  9. They had 9 children of whom four survived to adulthood: Frederick Garland (b1828 Canada), Rose (b1831 Canada), Clarence Macbreedy (b1836 England) & Richard Armstrong (b1842 England)
  10. Frederick Thomas died of pneumonia which might explain why he died intestate
